    Definition Vor dem 13.Jhrd. galt in weiten Teilen Europas ein Strafprozessrecht, das als akkusatorisch bezeichnet wird. Es besagte, dass ein Privatkläger die Einleitung und Durchführung eines Strafprozesses vollziehen muss. Dieser Privatkläger gehörte meistens zur Partei des Geschädigten oder zu dessen Verwandtschaft. Danach setzte sich in Kontinentaleuropa das sogenannte inquisitorische Verfahren durch, bei dem der Kläger nicht mehr der Prozessführer war; die Justizbehörden kontrollierten nun alle Stadien des Prozesses, sobald eine Anklage erhoben wurde.
