—(1) If on the consideration under this Act of a petition and report the county council or all the county councils to which such petition was presented duly passes or pass a resolution that the petition and report be treated as a petition and report made under the Arterial Drainage Act, 1925 (No. 33 of 1925), the petition and report shall be deemed to have been duly presented and made under that Act and that Act shall apply accordingly.

When a petitioner consents to withdraw his petition, or to allow it to be dismissed, or the hearing adjourned, or fails to appear in support of his petition when it is called in Court on the day originally fixed for the hearing thereof, or on any day to which the hearing has been adjourned, or if appearing, does not apply for an order in the terms of the prayer of his petition, the Court may, if, and upon such terms as it shall deem just, substitute as petitioner any person who would have a right to present a petition, and who desires to prosecute the petition.

Upon the presentation of a petition for adjudication, the petitioner shall deposit with the Official Assignee, in the case of a petition by a debtor, the sum of £100, and in the case of a petition by a creditor, the sum of £75, and shall thereafter lodge such further sums (if any) as the Court may from time to time direct, to cover the fees and expenses to be incurred by the Official Assignee and no petition shall be received unless the receipt of the Official Assignee for the deposit payable on the presentation of the petition is produced to the proper officer.

( b ) if a petition has been presented to the Circuit Court and has not been withdrawn, then at the first sitting of that court held after the expiration of one week from the date of the presentation of the petition or of the prescribed period, whichever shall be the later, or at such later date as the court shall direct, the court shall hear the petition and determine all questions arising thereon, and may either confirm with or without amendment or disallow the order and may award costs to be paid by or to the petitioner or any party opposing the petition;

(6) Where any such petition is presented to the councils of two or more counties pursuant to this Act such councils may combine for the purpose of considering such petition and, in lieu of referring the petition to the county surveyor of each such county, may refer the petition to the county surveyor of one such county and in such case every such council may act under this section on the report of such county surveyor.

( b ) if the sum stated in such report as the probable total cost of the execution of the drainage works proposed in such petition exceeds one thousand pounds or effect cannot be given to the proposals contained in such petition without infringing some provision of this Act, the council may either pass a resolution that the petition and report be treated as a petition and report made under the Arterial Drainage Act, 1925 , (No. 33 of 1925) or pass a resolution disapproving of such proposals.

(3) Where, in a referendum petition or any particulars filed in relation thereto or at the hearing of a referendum petition, any particular person is alleged to have been guilty of a corrupt practice in relation to the referendum or where a copy of a referendum petition is served on a particular person by direction of the High Court, the High Court may, on the application of that person, add or name him as a respondent to such petition.

( c ) if the petitioner fails to proceed with reasonable speed with the proceedings on the petition, the High Court may, on the application of the Attorney-General, either forthwith make a final order confirming without alteration the provisional referendum certificate which was the subject of the petition or transfer the carriage of the petition to the Attorney-General and authorise him to proceed on the petition as if it had been presented by him;

—(1) Where a petition of bankruptcy or a petition for arrangement is presented, the registrar of the court shall furnish the Registrar with notice of the presenting of the petition and the Registrar shall thereupon cause an entry to be made in the register inhibiting, for a period of three mouths from the date of the petition, any dealing with any registered land or charge which appears to be affected.

Every petition for the winding up of a company by the Court shall be verified by affidavit. Such affidavit which shall be in one of the Forms Nos. 6 or 7, shall be made by the petitioner, or by one of the petitioners if more than one, or in case the petition is presented by a corporation or company, by some director, secretary or other officer thereof, and shall be sworn after and filed within four days after the petition is presented, and such affidavit shall be sufficient prima facie evidence of the statements in the petition.

Every petition under the Act shall be accompanied by an affidavit made by the petitioner verifying the facts and matters stated in such petition of which he has personal knowledge and deposing as to his belief in the truth of the other facts and matters alleged in the petition; and every such affidavit shall contain a denial of collusion with any persons or person; provided, however, that if the petitioner shall be an infant under the age of eighteen years, or a person of unsound mind, or if for any special reasons the petitioner is unable to make such an affidavit, the Court or the Master, on an affidavit stating the facts by reason of which it is desired that the petition should be verified by some person other than the petitioner, may by order allow the petition to be verified by some other person to be named in said order, and also allow such other person to make an affidavit denying collusion.
