    Comment Das EWR-Abkommen, dessen Vertragsparteien alle Mitgliedstaaten der EU und die EFTA-Mitglieder Island, Liechtenstein und Norwegen sind, trat am 1. Januar 1994 in Kraft. Sein Ziel ist die Schaffung eines dynamischen, homogenen Europäischen Wirtschaftsraums. In formeller Hinsicht bestehen im EWR zwei getrennte Rechtssysteme: Das EWR-Abkommen wird angewandt, wenn der Handel zwischen EFTA-Ländern und der Gemeinschaft oder zwischen EFTA-Ländern beeinträchtigt wird, während das Gemeinschaftsrecht bei einer Beeinträchtigung des Handels zwischen Mitgliedstaaten der EU herangezogen wird. Das EWR-Abkommen wird sowohl von der Europäischen Kommission als auch von der EFTA-Überwachungsbehörde(EÜB) angewandt.
