- Comment Bei förmlichen Beschwerden ist die Kommission verpflichtet zu handeln (entweder Feststellung einer Zuwiderhandlung oder Abweisung der Beschwerde), wobei der Beschwerdeführer bestimmte Verfahrensrechte hat. Dazu gehören das Anhörungsrecht und – in Verfahren nach der Verordnung Nr. 17 – das Recht auf Einsicht in die Akten der Kommission (das allerdings im Vergleich zum Recht der Parteien, die Gegenstand eines Prüfverfahrens sind, eingeschränkt ist). Informelle Beschwerden (bei denen der Beschwerdeführer eine Offenlegung der von ihm gemachten Angaben verweigert) oder anonyme Beschwerden können die Kommission zur Einleitung einer Untersuchung veranlassen, wobei dem Beschwerdeführer aber keine Rechte gewährt werden

- Comment Formal complaints oblige the Commission to act (either to find that there is an infringement or to reject the complaint) and give the complainant certain procedural rights, like the right to be heard and - in proceedings under Regulation 17 - access to the Commission's file (albeit limited in comparison to the parties concerned by an investigation). Informal complaints (where a complainant refuses disclosure of the information he provides) or anonymous complaints may lead the Commission to open a case, but confer no rights to the complainant.

- Definition Demande introduite par une personne physique ou morale faisant valoir un intérêt légitime, afin que la Commission examine une prétendue infraction au droit communautaire de la concurrence et y mettre fin. Dans le cas du dépôt d'une plainte formelle, la Commission est appelée à statuer (c'est-à-dire soit à établir l'existence d'une infraction, soit à rejeter la plainte) et à accorder certains droits procéduraux au plaignant, tels que le droit d'être entendu et - dans les procédures ouvertes en application du règlement n° 17 - l'accès au dossier (bien qu'il soit limité par rapport à celui des parties concernées par une enquête). Une plainte informelle (lorsqu'un plaignant s'oppose à la divulgation des renseignements qu'il a fournis) ou une plainte anonyme peuvent amener la Commission à engager une procédure d'office, mais ne confèrent aucun droit au plaignant.
