- Comment "Prior checking (Article 27) is no longer required following the repeal of Regulation (EC) No 45/2001 by Regulation (EU) 2018/1725. The new procedure is called ""prior consultation"" [ IATE:836814 ]. While the criteria for prior checking under the old Regulation and prior consultation under the new Regulation are not identical, there is a certain overlap – most processing operations requiring a data protection impact assessment under the Regulation already required prior checking under the old Regulation. There are also processing operations that required prior checking under the old Regulation, but which will not require a data protection impact assessment."
