En principe, seul le maire a compétence pour célébrer les mariages, mais il peut déléguer ce pouvoir aux adjoints ou aux conseillers municipaux (mais non à un secrétaire de mairie ou à un fonctionnaire municipal). Si le maire refuse de procéder à la célébration d’un mariage, l’adjoint est également obligé de s’abstenir.
