    Comment It is not possible for a ship to sail under the EU flag. According to Article 91 of the UN Convention on the Law of the Sea, it is for an individual State to fix the conditions for the grant of its nationality to ships, for the registration of ships in its territory, and for the right to fly its flag. Ships may sail under the flag of one State only and are subject to that State's exclusive jurisdiction on the high seas.Unofficial European civil ensigns, some designs of depict the EU flag with the national flag of one of the EU member states in canton, may be encountered on European waterways. These flags do not have official status and cannot replace the legally required national civil ensign.

    Comment Le terme "pavillon européen" désigne parfois aussi, par extension, le drapeau européen ou un drapeau européen comportant le pavillon national d'un pays européen dans le coin supérieur gauche. Ces pavillons européens ne sont pas reconnus en tant que pavillon national. Ils s'apparentent aux pavillons de courtoisie ou aux pavillons du propriétaire, au même titre que les pavillons régionaux, et n'ont aucun caractère officiel.
