    Comment UK legal systems Regarding 'rights of access' referred to in article 2(10) of Council Regulation (EC) No 2201/2003, cf article 5 of the Hague Convention. The term 'access rights' was replaced in EN by Children Act 1989 and in SC by Children (Scotland) Act 1995 but is still in regular use (eg Official Solicitor site (child abduction unit)) ECHR right to family life and parental rights at common law include right of 'contact' but while there is a statutory definition in SC, there is none in EN. A "contact order" means an order requiring the person with whom a child lives, or is to live, to allow the child to visit or stay with the person named in the order, or for that person and the child otherwise to have contact with each other (Children Act 1989, Section 8(1)) This right arises only after judicial intervention. . Irish legal system The Law Reform Commission recommended in a report in 2010 that the terminology of family law be changed to replace ‘guardianship’ with ‘parental responsibility’, ‘custody’ with ‘day-to-day care’ and ‘access’ with ‘contact’ in order to more accurately reflect what these concepts mean and to be closer to the terminology used in EU legislation. The law has not changed yet and in The Children and Family Relationships Bill, a draft piece of legislation that should change the law in this area the terms “guardianship”, “custody” and “access” have been retained because these are used in a Constitutional amendment on this subject but the definitions are those proposed in the Law Reform Commission report. At the moment, when Irish case law or literature refers to “contact rights” it is usually a reference to the concept in the Hague convention.
