    Comment [2013] En France, les droits politiques, strictement liés à la citoyenneté française (droit de vote et d’éligibilité) ne sont pas reconnus aux étrangers, à l’exception des ressortissants communautaires pour les élections municipales et européennes. Certes, le débat sur le droit de vote des étrangers, au moins aux élections locales, demeure. Mais ce droit de vote n’est pas encore une réalité. La "convention sur la participation des étrangers à la vie publique au niveau local" http://conventions.coe.int/treaty/fr/Treaties/Html/144.htm [02.06.13] n'a été ni signée ni ratifiée par la France. Il existe toutefois en France des outils de participation des étrangers à la vie publique locale: en 1981 et 1982, le Conseil constitutionnel a jugé que les étrangers peuvent participer aux élections universitaires (Cons. const., déc. n° 81-130 DC, 30 oct. 1981 : Rec. Cons. const. 1981, p. 31) et aux élections aux organismes de sécurité sociale (Cons. const., déc. n° 82-148 DC, 14 déc. 1982 : Rec. Cons. const. 1982, p. 73: "les élections prévues pour la représentation des assurés sociaux ne se rapportent ni à l'exercice des droits politiques ni à la désignation des juges"), contribuant ainsi à faire apparaître que pour les élections corporatistes (par opposition aux élections politiques nationales ou locales), qui ne sont pas l'expression de la souveraineté nationale, la qualité de citoyen français n'est pas requise.
