    Nóta Le Tribunal de Nuremberg a énoncé une première définition synthétique des crimes de guerre, qui a ensuite été complétée par les quatre conventions de Genève du 12 août 1949 réglementant la conduite des hostilités lors des conflits armés internationaux, puis par deux Protocoles additionnels adoptés le 8 juin 1977, notamment pour renforcer la protection dans le cadre des conflits armés non internationaux. Les statuts des juridictions pénales internationales mises en place pour juger les crimes commis en Ex –Yougoslavie en 1993 (TPIY) et au Rwanda en 1994 (TPIR), ainsi celui de la Cour pénale internationale (CPI) créée en 1998, ont également été inspirés, pour la définition des crimes de guerre, du statut du Tribunal de Nuremberg et des quatre conventions de Genève. Cependant, des éléments nouveaux ont été introduits en ce qui concerne la nature des actes pouvant être considérés comme rentrant dans la catégorie des crimes de guerre et le contexte de commission des actes incriminés (emploi d’armes non toxiques, actes de terrorisme) ou à la poursuite de crimes commis en cas de conflits armés non internationaux (art. 8, § 2, c, du statut de la CPI et art. 4 du TPIR).
