Definition an aspect of the international law of war which addresses the practices forbidden to belligerents during a war, defining standards by which a country can conduct war Reference "'jus in bello', USLegal Definitions, http://definitions.uslegal.com/j/jus-in-bello/ [6.9.2016]"
Comment "'Jus in bello' is a group of principles intended as guidelines for the just prosecution of war, which includes two principles of discrimination and proportionality. Discrimination defines legitimate targets and proportionality defines how much force could be used. Some sources (e.g. ICRC) treat law of armed conflicts, jus in bello and international humanitarian law as synonyms. But these terms should not be used interchangeably. Many academic sources tend to regard 'law of armed conflict' [ IATE:3505670] as a broad concept which encompasses:- international humanitarian law [ IATE:126909 ],- jus ad bellum [ IATE:3543225 ] and- jus in bello. Some sources make the opposite hierarchy, with international humanitarian law as the broader concept.
