- Comment It may include other species, such as shrubs or trees, which can be grazed and, where Member States so decide, other species such as shrubs or trees which produce animal feed, provided that the grasses and other herbaceous forage remain predominant.Member States may also decide to consider the following types of land to be permanent grassland:(i) land which is covered by any of the species referred to in this point and which forms part of established local practices, where grasses and other herbaceous forage are traditionally not predominant or absent in grazing areas;(ii) land covered by any of the species referred to in this point, where grasses and other herbaceous forage are not predominant or are absent in grazing areas. The terms ‘permanent grassland’ and ‘permanent pasture’ have both been used in EU legislation, but they have been defined in the same way and no distinction has been drawn between them. The use of different terms in different acts appears to be accidental. Recent documents refer to ‘permanent grassland and permanent pasture’ (in order to apply to the same reality, whichever term was used in previous legislation), and Article 4(3)(c) of Regulation (EU) No 2021/2115 defines ‘permanent grassland and permanent pasture’ as a single concept, ‘together referred to as “permanent grassland”’.
