    Comment Im deutschen Recht wurde der subsidiäre Schutz in § 60 II-VII AufenthG verankert. Nicht zu verwechseln ist der „subsidiäre Schutz“ mit dem § 60 I AufenthG, der die Umsetzung des Refoulement-Verbots aus der Genfer Flüchtlingskonvention enthält [vgl. IATE:3584077 ]. Beide Rechtsinstitute werden im deutschen Rechtssystem unter dem Begriff „Abschiebungsverbot“ ( IATE:3585234 ) zusammen gefasst.

    Comment Humanitarian protection' (HP) is the term UK authorities use for subsidiary protection in the UK. Before 1 April 2003, the system of subsidiary protection used was 'Exceptional Leave to Remain' (ELR). HP is now regulated by two legal instruments adopted pursuant to the Qualification Directive, the Refugee or Person in Need of International Protection (Qualification) Regulations 2006 and the 'Statement of Changes in Immigration Rules, CM 6918'. . In Ireland, before the transposition of the Qualification Directive, there was no subsidiary protection regime. An application for subsidiary protection will only be considered following the determination by the Minister of an application for asylum by the applicant. If an applicant is refused a declaration of refugee status he or she will be notified of this decision by the Minister for Justice and Law reform and will be given the option of applying for subsidiary protection and of making representations as to why a deportation order should not be made against him or her. The Minster has the power under the European Communities (Eligibility for protection) Regulations 2006 SI 518/2006 http://www.irishstatutebook.ie/2006/en/si/0518.html [18.12.2014] to grant applications for Subsidiary Protection. Applicants granted subsidiary protection are granted permission to remain in the State for a period of three years, whis is renewable unless compelling reasons of national security or public order otherwise require. .
