Le fait que des activités puissent ou non être appelées "travail des enfants" dépend de l'âge de l'enfant, de la nature du travail accompli, du nombre d'heures réalisées, des conditions dans lesquelles ce travail est effectué et des objectifs poursuivis par chaque pays. Les activités qui ne nuisent pas à la santé et au développement personnel de l'enfant ni n'interfèrent avec sa scolarité ne sont généralement pas considérées comme "travail des enfants". Exemples: aider ses parents à la maison; gagner de l'argent de poche en dehors des vacances scolaires.2. Aux termes de l'article 32 de la Charte des droits fondamentaux de l'Union européenne, "[l]e travail des enfants est interdit. L'âge minimal d'admission au travail ne peut être inférieur à l'âge auquel cesse la période de scolarité obligatoire, sans préjudice des règles plus favorables aux jeunes et sauf dérogations limitées."
