    —If the Company fail within the period limited by this Act to complete the said railways and open the same for public traffic, the Company shall be liable to a penalty of £50 a day for every day after the expiration of the period so limited until the railways are completed and opened for public traffic or until the sum received in respect of such penalty amounts to five per centum of the estimated cost of the works and the said penalty may be applied for by any road authority landowners or other person claiming to be compensated or interested in accordance with the provisions of the next following section of this Act and in the same manner as the penalty provided in section 3 of the Railway and Canal Traffic Act, 1854.

    —(1) The power of purchase which by section 51 of the Dublin United Tramways (Electrical Powers) Act, 1897, as amended by sections 11 and 15 of the Dublin United Tramways Act, 1905 is conferred upon every road authority in respect of the tramways in that section mentioned within the district of that authority shall apply to the railways acquired by and vested in the Company by virtue of the provisions of this Act and to all tramways and railways which the Company may hereafter construct or acquire and the provisions of that section shall apply to those railways and tramways and to all lands works materials and plant used by the Company for the purpose of their undertaking within such districts if they had been part of the tramways as in that section defined.

    (2) The Commissioners may also cause the subsoil under public or private roads, highways, streets and footpaths, and any tunnels, streams, watercourses, sewers, drains, pipes, hydrants, gas mains, electric cables, wires and apparatus as shall be in or near the intended situation of the works to be either temporarily or permanently opened up, broken up, crossed, altered, extended, diverted or otherwise interfered with as they shall think necessary or convenient for making and completing the works or in connection with the works or any of them or the operations or conveniences connected therewith or for any of the purposes of their undertaking, provided that the Commissioners do previous to opening up or otherwise interfering with the same make, in consultation with the road authority (within the meaning of the Local Government Act, 1946 ), all necessary arrangements to ensure the safety and stability of any road, highway, street or footpath the subsoil under which is opened up, broken up, crossed, altered, extended, diverted or otherwise interfered with under this Order, and provide in lieu of such tunnels, streams, watercourses, sewers, drains, pipes, hydrants, gas mains, electric cables, wires or apparatus, good and sufficient means for conveying off the water and sewage from the adjoining or neighbouring lands and premises affected and efficient alternative electric cables, wires or other apparatus for such purposes as the electric cables, wires and other apparatus so to be altered or interfered with are accustomed to serve, as convenient in all respects as the tunnels, streams, watercourses, sewers, drains, pipes, hydrants, gas mains, electric cables, wires and apparatus to be opened up, broken up, crossed, altered, extended, diverted or otherwise interfered with as aforesaid.
