(3) Every person who fails within the time limited in that behalf by the Commission to furnish to the Commission any information lawfully required of him by the Commission under this section and every bank which fails within the time limited in that behalf by the Commission to afford the Chairman or such officer as aforesaid any access to books or records lawfully required of him by the Commission under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds for every day during which such failure is continued

(4) The Commission may require any Shareholding Bank to give to the Commission security to such amount as the Commission shall direct for consolidated bank notes theretofore or thereafter issued to such Bank by the transfer (by way of security only and not absolutely) to the Commission of assets of such Bank acceptable to the Commission or by such charge in favour of the Commission on such assets of such Bank as shall be acceptable to the Commission.

(2) The Commission shall carry to the general fund all moneys received by the Commission and not required by this Act to be carried to the legal tender note fund or paid into the note reserve fund and the Commission shall draw out of the general fund all, payments made by the Commission and not required by this Act to be paid out of the legal tender note fund or out of the note reserve fund, and in particular shall pay out of the general fund the expenses of the Commission.

—(1) The Commission may, during an investigation by it under this Act in relation to goods of any kind, recommend to the Minister that a provisional duty of such amount (not exceeding the margin of dumping estimated by it in relation to the goods) as the Commission may specify be imposed on such goods of that kind as the Commission may specify for such period or periods not exceeding six months as the Commission may specify.

—(1) If, as result of an investigation by the Commission under this Act, the Commission is satisfied that there has been injurious dumping of goods of any kind, the Commission may recommend to the Minister that an anti-dumping duty of such amount (not exceeding the margin of dumping in relation to the goods) as the Commission may specify be imposed on those goods or on such goods of that kind as the Commission may specify for such period or periods as the Commission may specify.

(3) The Minister for Arts, Heritage, Gaeltacht and the Islands, if so requested by the Commission following consultation by the Commission with An Coimisiún Um Radio agus Telefís Neamhspleách — The Independent Radio and Television Commission ("the Independent Commission") and consideration of any proposals of the Independent Commission for broadcasts in connection with the referendum by sound broadcasting contractors or television programme service contractors that it communicates to the Commission, shall direct the Independent Commission in writing to arrange for the provision for and on behalf of the Commission of services (with or without charge) including the allocation of broadcasting time to facilitate the Commission in performing its functions, and the Independent Commission shall comply with a direction under this subsection.

(3) The Commission, or a person appointed by the Commission, possessing, in the opinion of the Commission, the requisite degree of independence from the postal service provider concerned, may, in accordance with procedures established and maintained by the Commission, resolve disputes which remain unresolved after due completion of all the procedures of a code of practice drawn up under subsection (1) and, in this regard, the Commission may issue directions to a postal service provider requiring the postal service provider to comply with such measures as it, or such person as may be appointed by the Commission under this subsection, may specify for the resolution of the dispute including payment of costs in the case where such a person is appointed, and reimbursement of payments or compensation, or both reimbursement of payments and compensation, as appropriate, in accordance with the provisions of the code of practice relating to the matters specified in subsection (1)(e).

(7) Whenever the Commission has fixed a maximum limit under the foregoing sub-section, the Commission may at any time thereafter remove such maximum limit and if such maximum limit is so removed during the initial period the Commission shall forthwith fix the maximum limit at six million pounds and if such first-mentioned maximum limit is so removed after the expiration of the initial period the Commission shall forthwith fix the maximum limit at such amount as it considers proper having regard to the total amount of liquid sound advances by Shareholding Banks to persons in Saorstát Eireann then existing and other assets and liabilities of the Shareholding Banks and such other matters as it considers relevant, and whenever the Commission fixes a maximum limit under this sub-section such maximum limit shall be and continue to be the maximum limit during the residue of the initial period or the triennial period (as the case may be) then current.

(3) Where the Minister requests the Commission to inquire into the prices charged for a commodity or the Commission resolve to inquire into the prices charged for a commodity, the, Commission shall hold an investigation (in this Act referred to as a price investigation) into the prices charged for such kind or kinds (defined in such manner and by reference to such things as the Commission think proper) of the said commodity as the Commission determine when sold, under such set or sets of conditions (defined in such manner and by reference to such things as the Commission think proper) as the Commission determine in such area or areas as the Commission determine

The company argued that: (i) the Commission acknowledged that the price of the product concerned was volatile but, in its view, this was not consistent with the allegation that the Korean imports suppressed the prices of the Union industry, (ii) the Commission argued that LG Chem exported 10 different product types that could be identified by factors such as the shape of the product granules, the degree of porosity, the bulk density and the particle size distribution, contrary to the general disclosure document where the Commission based the undercutting and injury margin calculation on a simplified PCN, which only considers the inclusion of odour control and the use of the product (hygienic against industrial), (iii) in the general disclosure document the Commission did not consider the SAP price formula and the Union producers’ costs as relevant factors causing injury to the Union industry, while it did consider it to reject the undertaking offer, (iv) the Commission took into account the relevance of long-term and global allocation contracts to reject LG Chem’s undertaking offer, but did not consider it in the general disclosure document, especially as regards the export performance of the Union industry and the effects of imports from Japan.
