(2) Más rud é gur comhlacht corpraithe a dhéanfaídh cion faoin Rialachán seo agus go gcruthófar gur le toiliú nó le cúlchead ó stiúrthóir, ó bhainisteoir ó rúnaí nó ó oifigeach eile de chuid an chomhlachta corpraithe a dhéanfar é nó go mbeidh a dhéanamh inchurtha i leith faillí aon duine acusan, measfar an cion sin a bheith déanta freisin ag an stiúrthóir, ag an mbainisteoir, ag an rúnaí nó ag an oifigeach eile nó ag aon duine a airbheartóidh gníomhú ar cháil sin, agus measfar eisean chomh maith leis an gcomhlacht corpraithe a bheith ciontach sa chion.
(2) Where an offence under this Regulation is committed by a body corporate and is proved to have been so committed with the consent or connivance of or to be attributable to any neglect on the part of a director, manager, secretary or other officer of the body corporate, the director, manager, secretary or other officer or any person purporting to act in such capacity shall also be deemed to have committed the offence and he, as well as the body corporate, shall be deemed to be guilty of the offence.
