‘high-efficiency cogeneration’ means cogeneration meeting the criteria laid down in Annex III;

High-efficiency cogeneration
Chun críoch na Treorach seo, comhlíonfaidh comhghiniúint ardéifeachtach na critéir a leanas:
For the purpose of this Directive, high-efficiency cogeneration shall fulfil the following criteria:

‘high-efficiency cogeneration’ means cogeneration which meets the criteria laid down in Annex II to Directive 2012/27/EU of the European Parliament and of the Council;

High-efficiency cogeneration and efficient district heating and cooling have significant potential for saving primary energy in the Union.

Member States should carry out a comprehensive assessment of the potential for high-efficiency cogeneration and efficient district heating and cooling.

High-efficiency cogeneration has been defined by the energy savings obtained by combined production instead of separate production of heat and electricity.

Requirements for high-efficiency cogeneration should be consistent with long-term climate policy goals.

A Member State may require the distribution system operator, when dispatching generating installations, to give priority to generating installations using renewable sources or using high-efficiency cogeneration, in accordance with Article 12 of Regulation (EU) 2019/943.

Construction, refurbishment and operation of combined heat/cool and power generation facilities using fossil gaseous fuels that meet the criteria in point 1(a) of Section 4.30 of Annex I. This activity does not include high-efficiency co-generation of heat/cool and power from the exclusive use of renewable non-fossil gaseous and liquid fuels referred to in Section 4.19 of Annex I and biogas and bio-liquid fuels referred to in Section 4.20 of Annex I.

Investment aid for high-efficiency cogeneration shall be exempted from the notification requirement of Article 108(3) of the Treaty only if it is not for fossil fuel fired cogeneration installations, with the exception of natural gas where compliance with the 2030 and 2050 climate targets is ensured in accordance with section 4.30 of Annex 1 to Commission Delegated Regulation (EU) 2021/2139.

To implement national comprehensive assessments, Member States should encourage the assessments of the potential for high-efficiency cogeneration and efficient district heating and cooling at regional and local level.

set up and make public their standard rules relating to the bearing and sharing of costs of technical adaptations, such as grid connections, grid reinforcements and the introduction of new grids, improved operation of the grid and rules on the non-discriminatory implementation of the grid codes, which are necessary in order to integrate new producers feeding electricity produced from high-efficiency cogeneration into the interconnected grid;

Set out measures to realise the potential of developing infrastructure for high-efficiency cogeneration or efficient district heating and cooling from waste heat and renewable energy sources, including in the industrial sector identified through a comprehensive assessment, in line with Article 25(1) of Directive (EU) 2023/1791.

guarantee the capability of transmission networks and distribution networks to transmit electricity produced from renewable energy sources or high-efficiency cogeneration with minimum possible redispatching, which shall not prevent network planning from taking into account limited redispatching where the transmission system operator or distribution system operator is able to demonstrate in a transparent way that doing so is more economically efficient and does not exceed 5 % of the annual generated electricity in installations which use renewable energy sources and which are directly connected to their respective grid, unless otherwise provided by a Member State in which electricity from power-generating facilities using renewable energy sources or high-efficiency cogeneration represents more than 50 % of the annual gross final consumption of electricity;
