Tar éis príomhimeachtaí dócmhainneachta a thionscnamh, ní chuirfear srian leis an Rialachán seo ar an gceart tionscnamh imeachtaí dócmhainneachta a iarraidh i mBallstát áit a bhfuil bunaíocht ag an bhféichiúnaí.
Following the opening of the main insolvency proceedings, this Regulation does not restrict the right to request the opening of insolvency proceedings in a Member State where the debtor has an establishment.
Ba cheart an bunús, an bhailíocht agus an méid ceart in rem den sórt a chinneadh de réir lex situs agus níor cheart go mbeadh éifeacht ag tionscnamh imeachtaí dócmhainneachta air.

údarás poiblí a bhfuil sé de cheart aige, faoi dhlí an Bhallstáit a bhfuil an bhunaíocht suite laistigh dá chríoch, tionscnamh imeachtaí dócmhainneachta a iarraidh.
a public authority which, under the law of the Member State within the territory of which the establishment is situated, has the right to request the opening of insolvency proceedings.
Tá an tacaíocht don ghearán ag an gcéim réamhthionscnaimh, chomh maith leis an anailís i gcéim an tseasaimh, á rialú ag Airteagal 5 den bhun-Rialachán, agus baineann siad le tionscnamh imeachtaí.
The support for the complaint at pre-initiation stage, as well as the standing analysis, are governed by Article 5 of the basic Regulation, and relate to the initiation of proceedings.
I measc cinntí ábhartha tá sáruithe ar rialacha substainteacha a dhearbhú, bearta idirlinne, orduithe stop agus scoir, tionscnamh imeachtaí cúirte nó clabhsúr a chur le cás.

(b) i gcás nach mbeidh aon socrú déanta ag na páirtithe maidir le tionscnamh imeachtaí dá dtagraítear i mír (a), ar an dáta a gheobhaidh an freagróir cumarsáid i scríbhinn ina mbeidh iarraidh go ndéanfar an díospóid a tharchur chun eadrána.
(b) where no provision has been made by the parties as to commencement of proceedings as referred to in paragraph
Sula dtionscnófar na príomhimeachtaí dócmhainneachta, ba cheart an ceart chun tionscnamh imeachtaí dócmhainneachta a iarraidh sa Bhallstát a bhfuil teaghlachas ag an bhféichiúnaí ann a theorannú do chreidiúnaithe áitiúla agus d'údaráis phoiblí nó do chásanna nach féidir príomhimeachtaí dócmhainneachta a thionscnamh faoi dhlí an Bhallstáit ina a bhfuil lárionad príomhleasa an fhéichiúnaí.
Prior to the opening of the main insolvency proceedings, the right to request the opening of insolvency proceedings in the Member State where the debtor has an establishment should be limited to local creditors and public authorities, or to cases in which main insolvency proceedings cannot be opened under the law of the Member State where the debtor has the centre of its main interests.
Dá bhrí sin, leagtar amach sa Rialachán seo dhá dháil shonracha inar féidir leis an gcúirt a bhfuil éileamh ar imeachtaí dócmhainneachta tánaisteacha a thionscnamh os a comhair, ar iarraidh ón gcleachtóir dócmhainneachta i bpríomhimeachtaí dócmhainneachta, tionscnamh imeachtaí den sórt sin a chur ar fionraí nó a dhiúltú.
Therefore, this Regulation sets out two specific situations in which the court seised of a request to open secondary insolvency proceedings should be able, at the request of the insolvency practitioner in the main insolvency proceedings, to postpone or refuse the opening of such proceedings.
Chun foráil na faisnéise chuig creidiúnaithe agus cúirteanna ábhartha a fheabhsú agus chun cosc a chur le tionscnamh imeachtaí dócmhainneachta eile i gcomhthráth, ba cheart ceangal a chur ar na Ballstáit faisnéis ábhartha i gcásanna dócmhainneachta trasteorann a fhoilsiú i gclár leictreonach a mbeidh rochtain ag an bpobal air.
In order to improve the provision of information to relevant creditors and courts and to prevent the opening of parallel insolvency proceedings, Member States should be required to publish relevant information in cross-border insolvency cases in a publicly accessible electronic register.
Ní dhéanfaidh tionscnamh imeachtaí dócmhainneachta difear do chearta in rem creidiúnaithe nó tríú páirtithe maidir le sócmhainní, bídís inláimhsithe nó doláimhsithe, inchorraithe nó dochorraithe, idir shócmhainní sonracha agus bhailiúcháin sócmhainní éiginnte ina n-iomláine a athraíonn ó am go chéile, ar leis an bhféichiúnaí iad agus atá suite i gcríoch Ballstáit eile tráth thionscnamh na n-imeachtaí.
The opening of insolvency proceedings shall not affect the rights in rem of creditors or third parties in respect of tangible or intangible, moveable or immoveable assets, both specific assets and collections of indefinite assets as a whole which change from time to time, belonging to the debtor which are situated within the territory of another Member State at the time of the opening of proceedings.
Ní dhéanfaidh tionscnamh imeachtaí dócmhainneachta difear do cheart creidiúnaithe fritháireamh a n-éilimh i gcoinne éilimh féichiúnaí a iarraidh, i gcás ina mbeidh fritháireamh den sórt sin ceadaithe faoin dlí is infheidhme ar éileamh an fhéichiúnaí dhócmhainnaigh.
The opening of insolvency proceedings shall not affect the right of creditors to demand the set-off of their claims against the claims of a debtor, where such a set-off is permitted by the law applicable to the insolvent debtor's claim.
Ní bheidh tionscnamh imeachtaí dócmhainneachta i gcoinne díoltóir sócmhainne mar fhoras chun an díolachán a chealú nó a fhoirceannadh agus ní dhéanfaidh sé sin an ceannaitheoir a chosc ó theideal a fháil i gcás ina mbeidh an tsócmhainn dhíolta, tráth tionscnaimh imeachtaí, suite laistigh de chríoch Bhallstáit seachas an Stát ina ndearnadh imeachtaí a thionscnamh.
The opening of insolvency proceedings against the seller of an asset, after delivery of the asset, shall not constitute grounds for rescinding or terminating the sale and shall not prevent the purchaser from acquiring title where at the time of the opening of proceedings the asset sold is situated within the territory of a Member State other than the State of the opening of proceedings.
Maidir le dlí an Bhallstáit a bhfuil teaghlachas de chuid an fhéichiúnaí lonnaithe ann, agus ar cuireadh an teaghlachas sin isteach i gclár poiblí de chuid an Bhallstáit sin nó ar Ballstát é a bhfuil maoin dhochorraithe lonnaithe ann ar leis an bhféichiúnaí í, i gcás go gceanglaítear le dlí an Bhallstáit sin go ndéanfar faisnéis maidir le tionscnamh imeachtaí dócmhainneachta dá dtagraítear in Airteagal 28 a fhoilsiú i gclár na talún, i gclár na gcuideachtaí nó in aon chlár poiblí eile, déanfaidh an cleachtóir dócmhainneachta nó an féichiúnaí atá i seilbh na bearta uile is gá chun a áirithiú go ndéanfar clárú den sórt sin.
Where the law of a Member State in which an establishment of the debtor is located and this establishment has been entered into a public register of that Member State, or the law of a Member State in which immovable property belonging to the debtor is located, requires information on the opening of insolvency proceedings referred to in Article 28 to be published in the land register, company register or any other public register, the insolvency practitioner or the debtor in possession shall take all the necessary measures to ensure such a registration.
Chun tionscnamh imeachtaí dócmhainneachta tánaisteacha a sheachaint, féadfaidh an cleachtóir dócmhainneachta sna príomhimeachtaí dócmhainneachta gealltanas aontaobhach a thabhairt (an “gealltanas”) maidir leis na sócmhainní atá lonnaithe sa Bhallstát ina bhféadfaí imeachtaí dócmhainneachta tánaisteacha a thionscnamh, go gcomhlíonfaidh sé, tráth a bheidh sé ag dáileadh na sócmhainní sin nó na bhfáltas a fuarthas mar thoradh ar iad a réadú na cearta dáilte agus tosaíochta a bheadh ag creidiúnaithe áitiúla faoin dlí náisiúnta dá mba rud é gur tionscnaíodh imeachtaí dócmhainneachta sa Bhallstát sin.
In order to avoid the opening of secondary insolvency proceedings, the insolvency practitioner in the main insolvency proceedings may give a unilateral undertaking (the ‘undertaking’) in respect of the assets located in the Member State in which secondary insolvency proceedings could be opened, that when distributing those assets or the proceeds received as a result of their realisation, it will comply with the distribution and priority rights under national law that creditors would have if secondary insolvency proceedings were opened in that Member State.
Roimh an cinneadh a dhéanamh bheith páirteach nó gan bheith páirteach sa chomhordú i gcomhréir le pointe (a) de mhír 1, gheobhaidh cleachtóir dócmhainneachta aon cheadú is gá faoi dhlí an Stáit maidir le tionscnamh imeachtaí a gceapfar é ina leith.
Prior to taking the decision to participate or not to participate in the coordination in accordance with point (a) of paragraph 1, an insolvency practitioner shall obtain any approval which may be required under the law of the State of the opening of proceedings for which it has been appointed.
Le bac ar ghníomhaíochtaí forfheidhmithe aonair i gcomhréir le hAirteagal 6 cuirfear ar fionraí, le linn an bhaic, tionscnamh imeachtaí dócmhainneachta, arna iarraidh sin do chreidiúnaí amháin nó níos mó, a bhféadfadh leachtú an fhéichiúnaí a bheith mar thoradh air.
A stay of individual enforcement actions in accordance with Article 6 shall suspend, for the duration of the stay, the opening, at the request of one or more creditors, of insolvency proceedings which could end in the liquidation of the debtor.
Sna cásanna sin, áiritheoidh na Ballstáit go bhféadfaidh údarás breithiúnach nó riaracháin a chinneadh tairbhe an bhaic ar ghníomhaíochtaí forfheidhmithe aonair a choinneáil i bhfeidhm, mura mbeadh tionscnamh imeachtaí dócmhainneachta, a bhféadfadh leachtú an fhéichiúnaí a bheith mar thoradh air, chun leas ginearálta na gcreidiúnaithe, agus imthosca an cháis á gcur san áireamh.
In such cases, Member States shall ensure that a judicial or administrative authority can decide to keep in place the benefit of the stay of individual enforcement actions, if, taking into account the circumstances of the case, the opening of insolvency proceedings which could end in the liquidation of the debtor would not be in the general interest of creditors.
Chun nach gcuirfear isteach ar riarachán éifeachtach an eastáit dócmhainneachta, déantar, sa Rialachán Dócmhainneachta a bheartaítear, dhá dháil shonracha a leagan amach inar féidir leis an gcúirt a bhfuil éileamh ar imeachtaí dócmhainneachta tánaisteacha a thionscnamh os a comhair, ar iarraidh ón gcleachtóir dócmhainneachta sna príomhimeachtaí, tionscnamh imeachtaí den sórt sin a dhiúltú nó a chur ar fionraí.
