The provisions concerning the procedures for implementing the decision on the granting of discharge to the Commission in respect of the implementation of the budget in accordance with the financial provisions of the Treaty on the Functioning of the European Union and the Financial Regulation are attached to these Rules as an annex [9].

Recalls that Parliament refused to grant discharge to the Committee’s secretary-general for the financial year 2018, on the grounds, inter alia, of a flagrant breach of the administration’s duty of care and of inaction, along with financial consequences, and was deeply disappointed about the lack of decisive action, in particular preventive and corrective measures, by the then director of human and financial resources, now the secretary-general, of the Committee until discharge for 2018 was refused;

Reminds that, Parliament, through its resolution of 21 October 2021 with observations forming an integral part of the decision on discharge in respect of the implementation of the budget of the European Border and Coast Guard Agency for the financial year 2019, called on the budgetary authority to place a part of the Agency’s 2022 budget in a reserve, to be released upon completion of seven conditions; regrets that following negotiations for the 2022 budget that reserve was not implemented; reiterates, however, that the Agency’s discharge of the 2019 financial year has made explicit that a failure to meet those conditions increases the risk of a refusal to grant the discharge for the financial year 2020; emphasises the need to evaluate the performance of the Agency on each of the 2019 conditions in the 2020 discharge, to nurture consistency between the discharges across the years, and as a means to assess the Agency’s performance, including on legal compliance; takes note in this context of the recent input received from the Commission in its letter addressed to the Committee on Budgetary Control on 24 March 2022 and of the state of play of the implementation of the conditions set in Parliament’s resolution of 21 October 2021, provided by the Agency at the same date;

Reiterates that the enhanced competences and resources allocated to the Agency must be accompanied by increased transparency and accountability, as well as full respect for and protection of fundamental rights; welcomes in this regard the use by the Agency of a Transparency Register and notes the prioritisation of efforts by both the management board and the executive management to further enhance integrity and accountability arrangements at the cross-Agency level; notes with satisfaction in this regard the establishment of an Internal Audit Capability and adoption of Internal Audit Charter in 2022; reiterates its dismay for the track record of the Agency under the leadership of the previous executive director with regards to accountability, transparency and respect for fundamental rights that was acting as executive director throughout the year 2021 and only resigned on 29 April 2022; welcomes the expressed commitment of the ad-interim executive management to fully address these issues; stresses that such accountability and transparency, and fundamental rights compliance are essential in the evaluation towards granting discharge to the Agency for the respective financial year;
