—(1) In this section the expression "authorised gas undertaker" means a person who is for the time being authorised by any local or personal Act of the United Kingdom Parliament or any private Act of the Oireachtas or any provisional or other order made under statutory authority (whether before or after the establishment of Saorstát Eireann) to supply gas to the public in any specified area and by virtue of such Act or Order has for the time being the right of so supplying gas in such area, and the expression "area of gas supply" means an area within which an authorised gas undertaker is for the time being so authorised to supply gas to the public and has for the time being the right of so supplying gas.

—(1) Where any gas undertaker is authorised by any special Act, Provisional or other Order or licence to supply gas in any area which is included in the area of supply of an authorised undertaker, and such gas undertaker is by virtue of such Act, Order, or licence under any general or limited obligation to supply gas upon demand, the Minister may, upon the application of such gas undertaker, inquire into the circumstances of the case, and if he is satisfied that any specified part of such area is sufficiently supplied with electricity, and that the supply of gas in such specified part has ceased to be remunerative to the said gas undertaker and that it is just that the said gas undertaker should be relieved from the obligation to supply gas upon demand as aforesaid, the Minister may in his discretion make an order relieving the said gas undertaker from such obligation within such specified part of such area either wholly or in part, and upon such terms and conditions as he thinks proper.

(2) An authorised gas undertaker may with the consent of the Minister and notwithstanding anything to the contrary contained in the Act or order constituting him to be such undertaker, become an authorised undertaker under this Act and whenever the Board constitutes an authorised gas undertaker to be an authorised undertaker the Board may with the consent of the Minister and, if so required by the Minister, shall insert in the special order effecting such constitution such special provisions, limitations, and conditions (including the keeping of separate accounts) as it thinks proper or (as the case may be) as the Minister may require and in particular may with the like consent by such special order authorise such undertaker to employ his funds and to raise capital and borrow money for the purposes of the electricity undertaking authorised by such order and may prescribe an area of supply either co-extensive with or greater or less than the area of gas supply of such undertaker.

—(1) Whenever the Minister considers it desirable that the charges to be made for gas supplied by any particular gas undertaker to whom section 1 of the Act of 1920 as amended by this Act does not apply should be charges for thermal units supplied in the form of gas, he may by order declare that such undertaker shall be deemed to be a gas undertaker who is required by enactment or other provision to supply gas of a particular illuminating or calorific value within the meaning of the said section and thereupon the said section shall apply to such undertaker with all necessary modifications and in particular with the modification that the standard or maximum price per therm which may be fixed by the Minister under the said section shall be such as he shall consider reasonable having regard to all the circumstances of the case.

(3) The Company shall not remove or displace any of the sewers, drains, mains, pipes, valves, syphons, plugs, tubes, wires or apparatus, or any other works belonging to or controlled by the Corporation or any person or do anything to impede the passage of sewage, drainage, gas, water, oil, petrol or electricity, into or through such sewers, drains, mains, pipes, valves, syphons, plugs, tubes wires or apparatus, without the consent of the Corporation, or such person, or in any other manner than the Corporation, or such person shall approve, until such good and sufficient sewers, drains, mains, pipes, valves, syphons, plugs, tubes, wires or apparatus and other works necessary or proper for continuing the drainage system or the supply of gas or water as efficiently as same was dealt with or supplied by the sewers, drains, mains, pipes, valves, syphons, plugs, tubes, wires, or apparatus proposed to be displaced or removed, shall, at the expense of the Company, have been first made and laid down in lieu thereof ready for use and to the reasonable satisfaction of the City Engineer or the engineer of such person as the ease may be or in the case of disagreement between the City Engineer or the engineer of such person and the Company as an engineer appointed by the Minister shall direct.

—(1) A buyer of gas supplied by means of a meter installed on premises in an area in which the jurisdiction conferred by the Act of 1859 is for the time being not exercisable may, unless such meter has been stamped by a special inspector of meters under section 6 (which relates to the stamping of meters in areas in which the Act of 1859 is not in force) of this Act, by notice in writing require the person by whom such gas is so supplied to remove such meter from such premises and procure the same to be tested by an inspector of meters appointed by a local authority under the Act of 1859 and if found correct to be stamped under that Act as amended by this Act accordingly.
