I gcás ina ndéanfaidh an foriarratas difear d'aon pháirtí eile seachas an t-iarratasóir, ní dhéanfar aon ordú ach amháin ar thoiliú ón bpáirtí sin arna thaispeáint go cuí don Chúirt, nó ar a chruthú fógra faoin bhforiarratas beartaithe agus cóip de na mionnscríbhinní mar thaca leis a bheith seirbheáilte go cuí ar an bpáirtí sin, ar an gcoinníoll go bhféadfaidh an Chúirt, más deimhin léi go dtiocfadh nó go bhféadfadh go dtiocfadh mísc thromaí den mhoill a bhainfeadh le dul ar aghaidh sa ghnáthshlí, aon ordú ex parte a dhéanamh ar cibé téarmaí is cóir leis an gCúirt i dtaobh costas agus eile, agus faoi réir cibé gealltanais (más ann) is cóir léi, agus go bhféadfaidh aon pháirtí dá ndéanfaidh an t-ordú sin difear foriarratas a dhéanamh chun é a chur ar ceal.
Where any party other than the applicant is affected by the motion, no order shall be made unless upon the consent of such party duly shown to the Court, or upon proof that notice of the intended motion and a copy of the affidavits in support thereof have been duly served upon such party, provided that the Court, if satisfied that the delay caused by proceeding in the ordinary way would or might entail serious mischief, may make any order ex parte on such terms as to costs and otherwise, and subject to such undertaking (if any) as the Court may think just, and any party affected by such order may move to set it aside.
