D’athdhearbhaigh na húsáideoirí ina bhfreagra ar an nochtadh sealadach nach mór na fíorais seo a leanas a chur san áireamh san anailís ar Leas an Aontais: (i) bhí TPE mar chéatadán den chostas táirgthe idir 30 % agus 60 % i gcás táirgeoirí uisce buidéalaithe agus idir 14 % agus 30 % i gcás táirgeoirí deochanna boga, agus mar sin bhí tionchar ard aige ar oibríochtaí agus ar bhrabúsacht na n-úsáideoirí, (ii) ceanglais a eascraíonn as an Treoir maidir le Plaisteach Aonúsáide (SUP), i.e. caipíní ceangailte ó mhí Iúil 2024 agus ionchorprú 25 % de TPE athchúrsáilte i mbuidéil phlaisteacha deochanna ó 2025 i leith, ag méadú go dtí 30 % faoi 2030), agus as an Rialachán maidir le Pacáistíocht agus le Dramhaíl ó Phacáistíochta (PPWR) a bhaineann le costas TPE athchúrsáilte níos airde ós rud é go leanann praghas TPE athchúrsáilte praghas TPE ógh ach go bhfuil sé i bhfad níos airde agus (iii) go bhfuil fás an tionscail TPE athchúrsáilte cosanta ar iomaíocht le TPE ón tSín, mar gheall ar an gcreat reatha agus rialála amhail an Treoir SUP agus formheas EFSA le haghaidh TPE athchúrsáilte biaghráid.
The users reiterated in their response to the provisional disclosure that the following facts must be taken into account in the analysis of the Union Interest: (i) PET as a percentage of the cost of production ranged between 30 % and 60 % for producers of bottled water and between 14 % and 30 % for producers of soft drinks, thus having a high impact on operations and profitability of the users, (ii) requirements stemming from the Single Use Plastic (‘SUP’) Directive, i.e. tethered caps from July 2024 and the incorporation of 25 % of rPET in plastic beverage bottles as from 2025 increasing to 30 % by 2030) and Packaging & Packaging Waste Regulation (PPWR) associated with a higher rPET cost since the price of rPET follows the price of vPET but it is substantially higher and (iii) the fact that the rPET industry’s growth is shielded from competition with PET from the PRC, due to the existing and future regulatory framework such as the SUP Directive and EFSA approvals for food grade rPET.
