(b) Where, in relation to the parking of a mechanically propelled vehicle, there is a contravention of a regulation under this section, each of the following persons shall be guilty of an offence--

(3) Before making bye-laws under this section (other than bye-laws relating to the fees to be paid in respect of the parking of vehicles), a road authority shall--

Parking of vehicles on public roads.

Rule 9 provides that a driver or other person in charge of a vehicle shall comply with a direction given to him by a member of the Garda Síochána in uniform in relation to the parking of the vehicle or its removal from the place where it is parked.

Where a roadway marking authorised by article 12 (1) (i) (inserted by the Road Traffic (Signs) (Amendment) Regulations, 1969 ( S.I. No. 217 of 1969 )) of the Regulations of 1962 is not accompanied by an information plate, the prohibition or restriction on the parking of vehicles imposed by means of a roadway marking shall apply during business hours.

(1) A person shall not with a vehicle enter a street or portion of a street to which this rule applies, or park a vehicle in such a street or portion of street during the period indicated by means of an information plate.

(2) Notwithstanding paragraph (1) (a) of this rule, a vehicle parked in a parking bay during business hours may project into an adjoining buffer area if the length of the vehicle prevents its being parked wholly in accordance with paragraph (1) (a) of this rule.

These bye-laws amend Part VII (inserted by the Dublin Traffic and Parking Bye-Laws, 1980 ( S.I. No. 82 of 1980 )) of the Dublin Traffic and Parking Bye-Laws, 1976 ( S.I. No. 83 of 1976 ) to distinguish bus lanes and bus-only streets and the restriction on traffic entering or parking on these bus lanes or bus-only streets.

An offence by a person under section 55 where the contravention involved the parking of a mechanically propelled vehicle and where any part of the period of the contravention was a period within lighting-up hours (as specified in the section) during which the vehicle did not fulfil the requirements imposed by law with respect to lighting and reflectors, being an offence committed in a period of 3 years in which a previous offence was committed by the person under that section for which he or she was convicted.

55.—(1) A person shall not park a vehicle in a public place if, when so parked, the vehicle would be likely to cause danger to other persons using that place.
