- Nóta 'The right to property is a traditional fundamental right in democratic and liberal societies. It is contained in all national constitutions and has been established by the case law of the Court of Justice. Article 17(1) of the EU Charter sets out the conditions governing this right, which are also applicable to intellectual property. The right to property is protected by an additional protocol to the European Convention on Human Rights (Article 1), and only the limitations for which it provides are admissible.
