Definition the illegal confinement of one individual against his or her will by another individual in such a manner as to violate the confined individual's right to be free from restraint of movement Reference "'false imprisonment'. The free Dictionary, http://legal-dictionary.thefreedictionary.com/False+Imprisonment [17.7.2015]"
Comment Any complete deprivation of freedom of movement is sufficient, so false imprisonment includes unlawful arrest and unlawfully preventing a person leaving a room or a shop. The restriction must be total: it is not imprisonment to prevent a person proceeding in one direction if he is free to leave in others. False imprisonment is a form of trespass to the person, so it is not necessary to prove that it has caused actual damage. It is both a criminal offence at common law and a tort. Damages, which may be aggravated or exemplary, can be obtained in tort and the writ of habeas corpus is available to restore the imprisoned person to liberty.

Definition placing a person under continuous supervision and control and preventing him/her from leaving Reference "Council-SK based on: Kingston Council, Deprivation of Liberty Safeguards (30.7.2020)"
Comment The right to liberty and security is enshrined in Article 5 of the European Convention on Human Rights, which sets out the cases where deprivation of liberty is justified. Article 5 (e) refers to 'the lawful detention of persons for the prevention of the spreading of infectious diseases, of persons of unsound mind, alcoholics or drug addicts or vagrants', thus 'deprivation of liberty' may also extend to the residents of a care home for the elderly or a rehabilitation centre, for example, who have been placed their in their own interests, rather than as a punitive measure.
