- Comment The right to liberty and security is enshrined in Article 5 of the European Convention on Human Rights, which sets out the cases where deprivation of liberty is justified. Article 5 (e) refers to 'the lawful detention of persons for the prevention of the spreading of infectious diseases, of persons of unsound mind, alcoholics or drug addicts or vagrants', thus 'deprivation of liberty' may also extend to the residents of a care home for the elderly or a rehabilitation centre, for example, who have been placed their in their own interests, rather than as a punitive measure.
