    Comment In order for Article 101 to apply to horizontal cooperation, there must be a form of coordination between competitors - in other words: an agreement between undertakings, a decision by an association of undertakings or a concerted practice.Horizontal cooperation may take the form of an agreement, whereby two or more undertakings have expressed the concurrence of wills to cooperate. A concerted practice is a form of coordination between undertakings in which they have not reached an agreement but knowlingly substitute the risks of competition through practical cooperation. The concept of a concerted practice implies, in addition to the participating undertakings concerting with each other, subsequent conduct on the market and a relationship of cause and effect between the two.The existence of an agreement, a concerted practice or decision by an association of undertakings does not in itself indicate that there is a restriction of competition within the meaning of Article 101(1). For ease of reference, unless otherwise stated, in these Guidelines the term ‘agreement’ also covers concerted practices and decisions of associations of undertakings.Horizontal cooperation agreements can be entered into between actual or potential competitors.
