    Comment There is no equivalent rule in the UK that parties to a marriage can agree only to share the acquired assets (or fruits) of the marriage.     Comment C'est le régime que les époux acquièrent d'office en se mariant s'ils n'ont pas fait de contrat de mariage. . Chaque époux conserve comme biens personnels : les biens qu'il possédait avant son mariage ; les biens qui lui ont été donnés durant le mariage ; les biens dont il a hérité pendant le mariage. La communauté ne comprend que les biens qui ont été achetés pendant le mariage. Chacun des époux est seul responsable des dettes faites par lui, les dettes faites pour l'éducation des enfants ou l'entretien du ménage restant à la charge des deux époux. Chacun des époux a le pouvoir d'administrer seul les biens communs. Toutefois, un époux ne peut pas faire une donation portant sur un bien de la communauté, sans l'accord de son conjoint. De même, les époux ne peuvent pas, l'un sans l'autre, vendre, donner en usufruit ou en garantie des biens tels que : immeubles, fonds de commerce, exploitations... . Ce régime permet à l'époux qui souhaite créer un fonds de commerce pendant le mariage d'avoir l'assurance que ce bien appartienne en commun aux deux époux. Il permet également aux époux de constituer un patrimoine commun dont le conjoint survivant recueillera la moitié, au moment du décès.
