Definition A legal status that confers analogous rights to those conferred by marriage on couples who formalise their relationship in accordance with the law. Reference Oxford Dictionary of law, Oxford University Press, 2022, ISBN-13: 9780192897497
Comment "Following recent changes in the legislation, the term “civil partnership” now covers both same-sex and opposite-sex couples, and therefore presents the same characteristics as “pacte civil de solidarité”.In the UK system, the right to form a civil partnership has been extended to opposite-sex couples: - in England and Wales by the Civil Partnership (Opposite-sex Couples) Regulations 2019 (SI 2019/1458), - in Scotland by the Civil Partnership (Scotland) Act 2020 - in Northern Ireland by The Marriage (Same-sex Couples) and Civil Partnership (Opposite-sex Couples) (Northern Ireland) Regulations 2019. In Ireland, before the Marriage Act 2015, only same-sex couples could register a civil partnership. The Marriage Act having extended to same-sex couples the right to marry, it is no longer possible for any couple to form a civil partnership. Now, under Irish law, two people can obtain legal recognition of their relationship only by entering into marriage. Only same-sex couples that have registered their civil partnership under the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010 and did not choose the possibility to enter into marriage following the Marriage Act can maintain this status. In France, a ""pacte civil de solidarité"" or ""PACS"" is an agreement between two adults, who may be of the same sex or of opposite sexes, to formalise their lives together. It has been open to persons of opposite sexes since 1999, i.e. before the change of legislation in the UK."

Definition Civil partnership where one of the parties to it, or both, is not a national or a person treated as such, and they enter into the partnership for the (predominant) purpose of circumventing immigration rules. [IE; UK; EU] Reference "Source: (1) Immigration and Asylum Act 1999, Part 1, Section 24A [UK] (27.3.2024) (2) Civil Registration (Amendment) Act 2014, Part 2, (3) (27.3.2024) [IE] (3) European Parliament and Council Directive 2004/38/EC (27.3.2024) [EU]"
Comment To be distinguished from a partnership not recognised (or allowed) in UK as a civil partnership. This definition applies to both Irish and UK systems, although the scope of the notion ‘a person treated as such’ differs. In the Irish system, the relevant provision uses the concept of ‘foreign national’, which indicates, according to the Civil Registration (Amendment) Act 2014, ‘a person who is neither an Irish citizen, nor a citizen of a member state’. In the UK system, as stated in Section 62 of the Immigration and Asylum Act 1999, the relevant provision uses the concept of ‘not a relevant national’, where ‘relevant national’, according to Chapter 33 of the Immigration and Asylum Act 1999, Part I, refers to ‘a British citizen, an Irish citizen, or a person who is not an Irish citizen and who - (i) has leave to enter or remain in the United Kingdom which was granted by virtue of residence scheme immigration rules, or (ii) is an applicant for the purposes of regulation 4 of the Citizens’ Rights (Application Deadline and Temporary Protection) (EU Exit) Regulations 2020 (applications which have not been finally determined by the deadline) where the relevant period within the meaning of that regulation has not expired’.

Definition gesetzlich geregelte auf unbestimmte Zeit eingegangene Lebensgemeinschaft zweier gleichgeschlechtlicher Personen mit eheähnlichen Wirkungen [DE] Reference Directorate-General for Multilingualism, Court of Justice of the European Union.
    same-sex civil partnership
    en
Comment "In Ireland a statutory civil partnership registration scheme for same-sex couples had been set up under the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010. This provision has been partly repealed by the Marriage Act 2015, which extended the right to marriage to same-sex couples. Since then, under Irish law it is no longer possible to form a civil partnership: this term now only applies to same-sex couples who registered their civil partnership under the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010 and did not choose the possibility of entering into marriage following the Marriage Act 2015.In the UK system, the Civil Partnership Act 2004 Section 1 used to enable same-sex couples to obtain legal recognition of their relationship by forming a civil partnership. Now, the right to form a civil partnership has been extended to opposite sex couples (see note in entry 3583446)."
