    Comment Die Anmeldung von wettbewerbsbeschränkenden Vereinbarungen ist nicht nur zwingend vorgeschrieben, sondern Unternehmen, die sie ohne Genehmigung durchführen, laufen auch Gefahr, dass Zivilgerichte einen Verstoß gegen Artikel 81 Absatz 1 EG-Vertrag feststellen und den Vereinbarungen in Anwendung von Artikel 81 Absatz 2 die Geltung absprechen (Nichtigkeit). Ferner besteht das Risiko, dass die Kommission oder nationale Kartellbehörden auf der Grundlage von Artikel 81 EG-Vertrag ein Verbot (voraussichtlich mit Geldbußen) beschließen. Wenn Unternehmen eine Freistellung (Einzelfreistellung) oder ein Negativattest erhalten wollen, müssen sie die Vereinbarung mit dem Formblatt A/B nach Verordnung Nr. 17 bei der Kommission anmelden. Eine Anmeldung für eine Freistellung ist jedoch nicht erforderlich, wenn die fragliche Vereinbarung unter eine Gruppenfreistellungsverordnung fällt. Durch die Anmeldung einer Vereinbarung können Unternehmen Geldbußen nach Artikel 15 der Verordnung Nr. 17 abwenden. Gemäß der Fusionskontrollverordnung müssen Unternehmen alle Zusammenschlüsse von gemeinschaftsweiter Bedeutung – in der Regel innerhalb einer Woche ab dem Abschluss der Vereinbarung über den Zusammenschluss – mit dem Formblatt CO bei der Kommission anmelden. There is also the risk that the Commission or national cartel authorities adopt prohibition decisions (possibly with fines) on the basis of Article 81 EC Treaty. If undertakings wish to benefit from an exemption (see individual exemption IATE:1899616 ) or to obtain a negative clearance [IATE:1899563 ], they have to notify the agreement to the Commission under Regulation No 17 [IATE:1899664 ] on the basis of Form A/B [IATE:1899620 ]. However, notification for exemption is not necessary if the agreement in question is covered by a block exemption regulation [IATE:1899617 ]. Notification of an agreement affords the companies concerned immunity from fines under Article 15 of Regulation No 17. La notification d'accords restrictifs n'est pas obligatoire, mais les entreprises qui mettent en œuvre ces accords s'exposent à ce que des tribunaux civils les considèrent contraires à l'article 81, paragraphe 1, du traité CE et ne les fassent pas appliquer (cf. nullité), en vertu de l'article 81, paragraphe 2. Le règlement sur les concentrations oblige les entreprises à notifier toute concentration de dimension communautaire à la Commission sur la base du formulaire CO, normalement dans un délai d'une semaine à compter de la conclusion de l'accord de concentration. Les entreprises participantes ne sont pas autorisées à réaliser l'opération de concentration tant que celle-ci n'a pas été notifiée et que la Commission ne l'a pas déclarée compatible avec le marché commun.
