- Nóta Clawback is different from "hotchpot" [ IATE:1091408 ] in that it concerns forced heirship, and the recovery of gifts is not limited to 'persons entitled to succeed'.The systems in EU Member States vary, and in the law of England and Wales and that of Northern Ireland there is no forced inheritance and therefore no clawback. Nor will the courts entertain a claim for clawback even if they are applying a law which includes it. In Scotland there is forced inheritance in respect of moveable property, but the evidence is that clawback either does not exist in the UK or is only very limited. - Nóta Le "rapport" consiste à remettre dans la masse successorale les libéralités consenties avant le décès pour calculer la masse partageable par les héritiers; il suppose qu'il y a plusieurs héritiers et que c'est l'un d'eux (et non un tiers) qui était bénéficiaire de la libéralité (équivalant à une avance sur héritage).La "réduction" suppose l'existence d'un ou plusieurs héritiers réservataires et un dépassement de la quotité disponible; elle contraint les bénéficiaires des libéralités (héritiers ou non) à restituer aux héritiers réservataires la part excédant la quotité disponible.Ces deux opérations ne sont pas liées dans le temps (il n'y en a pas une qui précède l'autre), car elles concernent des personnes différentes (héritiers seuls pour le rapport et héritiers + tiers pour la réduction). Par ailleurs, il peut y avoir rapport sans réduction, comme il peut y avoir réduction sans rapport.N.B.: Le terme anglais "clawback" est utilisé dans les travaux préparatoires du règlement sur les successions pour décrire ce mécanisme, mais n'apparaît pas dans la législation.
