    Comment L’article 10 bis de la directive 2003/87/CE (directive SEQE) prévoit que des référentiels ex-ante doivent être établis pour l’Union, dans la mesure du possible, de façon à garantir que les modalités d’allocation des quotas encouragent l’utilisation de techniques efficaces pour réduire les émissions de gaz à effet de serre et améliorer le rendement énergétique et n’encouragent pas l’accroissement des émissions. Pour chaque secteur et sous-secteur, en principe, le référentiel est calculé pour les produits et non pour les intrants, de manière à maximiser la réduction des émissions de gaz à effet de serre et les gains d’efficacité énergétique tout au long du processus de production du secteur ou du sous-secteur concerné. Le point de départ est la performance moyenne des 10 % d’installations les plus efficaces d’un secteur ou sous-secteur de l'Union pendant les années 2007-2008. La mention «dans la mesure du possible» rend compte du fait qu'il était évident dès le départ que le nombre de produits différents fabriqués dans les installations relevant du SEQE de l’UE était trop important pour que des référentiels puissent être établis pour l’ensemble de ces produits. De fait, la liste des 52 référentiels de produit figurant dans les règles d’allocation à titre gratuit ne couvre que les deux tiers des allocations effectuées pour la troisième phrase. Pour le reste, des méthodes dites «alternatives» ont été mises au point («référentiel de chaleur», «référentiel de combustibles», «émissions de procédé»).
