    Comment "- Whereas joint procurement under Directives 2014/24/EU and Financial Regulation 2024/2509 (Article 168(2)) applies across all domains, ‘common procurement’ is a more specific form of joint procurement introduced by the EDIRPA regulation for use in the defence sector. Joint procurement in the water, energy, transport, and postal services sectors is governed by Directive 2014/25/EU.- A typical example of the use of ‘common procurement’ is the support of ammunition production, as governed by the ASAP regulation (cf. Art. 14)- Some specific characteristics of common procurement under the EDIRPA regulation include the availability of Union financing to incentivise procurement (Art. 7), the requirement for a lead buyer (the procurement agent, Art. 9(1)), the stipulation that contractors and subcontractors be based in the EU or associated countries and not controlled by unfriendly states (Art. 9(5)), and a prohibition on procuring defence products subject to any third-country restrictions (Art. 9(10)).- EDIP regulation proposal (doc. SN 2712/24 REV2, Art. 12.) stipulates that common procurement can be carried out by ""a consortium of at least three legal entities"" of which only two need to be contracting authorities of Member States. This consortium may include legal entities from associated countries or international organisations, SEAPs, or EDA."
