    Comment "Der italienische Begriff ""diffamazione"" lässt sich nicht eindeutig in den Aufbau der §§ 185 ff. StGB (Beleidigung/üble Nachrede/Verleumdung) einordnen. Am ehesten entspricht er wohl der üblen Nachrede, allerdings wird nach Art. 595 des Codice penale ( http://www.altalex.com/documents/news/2014/10/28/dei-delitti-contro-la-persona ) nicht unbedingt vorausgesetzt, dass ""in Beziehung auf einen anderen eine Tatsache behauptet oder verbreitet wird"", wie es in § 186 StGB ( http://www.gesetze-im-internet.de/stgb/__186.html ) heißt. Dies gilt vielmehr nur als schwererer Fall des Grundtatbestands der ""diffamazione"". Erst recht wird nicht vorausgesetzt, dass ""wider besseres Wissen ... eine unwahre Tatsache behauptet oder verbreitet"" wird, was das wesentliche Merkmal der Verleumdung (§ 187 StGB, http://www.gesetze-im-internet.de/stgb/__187.html ) darstellt. Das italienische Recht differenziert in erster Linie danach, ob die Person, deren Ehre verletzt wird, anwesend (siehe dazu IATE:3584222) oder abwesend ist."
