- Nóta "Der englische Begriff ""aggravated burglary"" entspricht keinem spezifischen deutschen Straftatbestand, sondern einer Kombination mehrerer Tatbestände. Der Bestandteil ""burglary"" ähnelt einem besonders schweren Fall des Diebstahls gemäß §§ 242 Abs. 1, 243 Abs. 1 Nr. 1 StGB ( http://www.gesetze-im-internet.de/stgb/index.html#BJNR001270871BJNE034105123 , üblicherweise als ""Einbruchdiebstahl"" umschrieben), jedoch muss der Einbruch nicht unbedingt mit dem Ziel eines Diebstahls erfolgen, sondern es kann auch eine Körperverletzung oder eine andere Straftat geplant sein. Dies erinnert an den Hausfriedensbruch ( § 123 StGB, http://www.gesetze-im-internet.de/stgb/__123.html ), der aber auch auf ""harmlosere"" Weise erfüllt werden kann. Durch den Zusatz des Wortes ""aggravated"" wird zum Ausdruck gebracht, dass der Täter eine Waffe, eine Scheinwaffe, ein gefährliches Werkzeug oder Sprengstoff mit sich führt. Dies entspricht mehr oder weniger dem Diebstahl mit Waffen gemäß § 244 Abs. 1 Nr. 1 StGB ( http://www.gesetze-im-internet.de/stgb/__244.html ). Es muss sich bei einem ""aggravated burglary"" nicht zwangsläufig um einen Wohnungseinbruch im Sinne von § 244 Abs. 1 Nr. 3 StGB handeln."
