Sainmhíniú medicinal product that infringes intellectual property rights Tagairt COM-Terminology Coordination in cooperation with DG SANTE
Nóta "Although it is possible to have falsified medicines 1 that are also counterfeit, not all falsified medicines are necessarily counterfeit, since falsification does not always imply infringement of intellectual property rights (IPR). For example, a medicine that is marketed by the legitimate market authorisation holder but does not contain one or more of the active ingredients that claims to contain, is falsified but not counterfeit. It is also possible to have counterfeit medicines that are not falsified (for example medicines that are authorised as generics in their country of manufacture but infringe IPR if imported into the EU). In practical terms, though, most counterfeit medicines intercepted to date fulfil the definition of falsified medicines. 1falsified medicine (broader) [ IATE:3500876 ] See also counterfeit medicine as used by WHO [ IATE:3566119 ] For more information on pharmaceutical patents, read: - TRIPS and pharmaceutical patents: fact sheet, https://www.wto.org/english/tratop_e/TRIPS_e/factsheet_pharm00_e.htm [4.8.2015]- Pharmaceutical patents and the TRIPS Agreement, https://www.wto.org/english/tratop_e/TRIPS_e/pharma_ato186_e.htm [4.8.2015]"
