- Nóta Somit trägt der Anhörungsbeauftragte zur Objektivität der Anhörung selbst, zur Beachtung von Fairnessgarantien, zur Wahrung des Rechts der Parteien auf rechtliches Gehör und zur Objektivität der späteren Entscheidung bei. Zu den Aufgaben des Anhörungsbeauftragten zählt es auch, bei Streitigkeiten zwischen den Kommissionsdienststellen und den betroffenen Parteien über Fragen der Vertraulichkeit von Unterlagen und über eine Einsichtnahme in die Akten zu vermitteln, die von einer oder mehreren Parteien zur Vorbereitung der Verteidigung verlangt wird. Der Anhörungsbeauftragte erstattet dem für Wettbewerb zuständigen Kommissionsmitglied Bericht; sein Abschlussbericht über eine Wettbewerbssache wird gemeinsam mit der Entscheidung im Amtsblatt veröffentlicht. Das Mandat des Anhörungsbeauftragten wurde in einem Beschluss der Kommission festgelegt

- Nóta "The Hearing Officer thus contributes to the objectivity of the hearing itself, the observance of due process, the respect of the parties' rights of defence and the objectivity of any decision taken subsequently. The tasks of the Hearing Officer also include resolving disputes between the Commission services and the parties concerned about the confidentiality of documents and access to the file which one or more of the parties claim in order to prepare their defence. The Hearing Officer reports to the Commissioner with special responsibility for competition; his final report on a competition case is attached to the decision and published in the Official Journal. The terms of reference of the Hearing Officer are laid down in a Commission decision. - Sainmhíniú Haut fonctionnaire indépendant chargé d'organiser les auditions et d'assurer leur bon déroulement. Il contribue au caractère objectif tant de l'audition elle-même que de toute décision ultérieure ainsi qu'au respect des formes régulières et des droits de la défense des parties. Le conseiller-auditeur a également pour mission de résoudre les différents opposant les services de la Commission aux parties concernées qui portent sur le caractère confidentiel des documents et sur le droit d'accès au dossier dont peuvent se prévaloir une ou plusieurs parties pour préparer leur défense. Il fait rapport au membre de la Commission chargé de la concurrence; son rapport final sur une affaire de concurrence est joint à la décision et publié au Journal officiel. Le mandat du conseiller-auditeur est défini dans une décision de la Commission.
