Comment eine Bestimmung, die eine Preisbindung der zweiten Hand vorsieht, wird im Allgemeinen als Kernbeschränkung betrachtet. Im Falle von Vertragsbestimmungen oder abgestimmten Verhaltensweisen, bei denen der Wiederverkaufspreis direkt festgesetzt wird, ist die Beschränkung eindeutig. Allerdings kann die Preisbindung der zweiten Hand auch auf indirektem Wege erreicht werden: zum Beispiel durch Festlegung der Handelsspanne oder des maximalen Preisnachlasses, den der Händler auf ein vorgeschriebenes Preisniveau gewähren darf, durch Bindung der Rabatte oder der Erstattung von Verkaufsförderungskosten durch den Lieferanten an die Einhaltung eines bestimmten Preisniveaus, durch Verknüpfung des vorgeschriebenen Wiederverkaufspreises an die Wiederverkaufspreise von Wettbewerbern oder durch Drohungen, Warnungen oder sogar Sanktionen gegen einen Händler, der ein bestimmtes Preisniveau nicht einhält (z. B. Strafen, Verzögerung oder Einstellung der Lieferungen oder Kündigung von Verträgen)

Definition Accords ou pratiques concertées entre un fournisseur et un distributeur ayant directement ou indirectement pour objet l'établissement d'un prix de vente fixe ou minimum ou d'un niveau de prix de vente fixe ou minimum que le distributeur doit appliquer lorsqu'il revend un produit/service à ses clients. Une disposition prévoyant des prix de vente imposés sera généralement considérée comme une restriction caractérisée. Lorsque des dispositions contractuelles ou des pratiques concertées fixent directement le prix de vente, la restriction est flagrante. Toutefois, un prix de vente peut aussi être imposé par des moyens indirects: à titre d'exemples, on pourrait citer un accord qui fixe la marge du distributeur ou le niveau maximum des réductions que peut accorder un distributeur à partir d'un certain niveau de prix prédéfini, un accord qui subordonne au respect d'un niveau de prix déterminé l'octroi de réductions ou le remboursement de coûts promotionnels par le fournisseur, le fait de relier le prix de vente imposé aux prix de vente pratiqués par la concurrence, ainsi que des menaces, des avertissements ou même des sanctions (telles que des pénalités, des retards ou suspensions de livraison ou la résiliation de l'accord) en cas de non-respect d'un certain niveau de prix.
