The concept is related to the lack of sufficient legal basis in domestic law for the protection of the right to law; absence of a legitimate purpose, including self-defence and the defence of others from violence; lack of absolute necessity for the use of lethal force; use of force that exceeds the legitimate purpose for which it is applied; and absence of an effective investigation into the circumstances that resulted in loss of life.
