Il s’agit d’une responsabilité de plein droit qui résulte du risque qui a été créé. En principe, les parents sont présumés solidairement responsables des fautes et dommages commis par leurs enfants mineurs à condition que: 1)les parents exercent l'autorité parentale. En cas de séparation, le parent qui n’exerce pas l’autorité parentale ne peut pas voir sa responsabilité engagée; 2) l’enfant habite avec ses parents.
