Droit français En droit français, les méthodes employées pour commettre la traite des êtres humains (circonstances particulières énumérées à l’article 225-4-1, alinéa I, points 1 à 4, du code pénal) ne constituent pas des circonstances aggravantes mais bien des éléments matériels constitutifs dont un au moins doit être constaté pour que l’infraction soit constituée. Toutefois, ces éléments ne sont pas requis dans le cas d’une victime mineure, où l’infraction est constituée par le seul fait de la recruter, de la transporter, de la transférer, de l'héberger ou de l'accueillir à des fins d'exploitation.Ne pas confondre avec la notion de “trafic d'êtres humains/trafic de personnes” (faux amis anglais: trafficking of human beings / trafficking in persons)Dans le cadre d’un trafic, les passeurs (IATE:3584166) s’en tiennent à un contrat consistant à faire passer des étrangers d’une frontière à une autre jusqu’à la destination finale (en échange d’une somme définie à l’avance). Une fois cela fait, autant les passeurs que les migrants ne conserveront pas de liens. Dans le cadre d’une traite, les organisations criminelles vont créer un lien de dépendance durable chez leurs victimes, même si elles peuvent parfois utiliser les filières d’immigration clandestines.
