Bei entsprechender Gestaltung lässt sich somit ein Sachverhalt konstruieren, bei dem die Hybridanleihe zu steuerlich abzugsfähigen Aufwendungen in einem Mitgliedstaat und zu steuerfreien Gewinnausschüttungen in einem anderen Mitgliedstaat führt.
