    Nóta Non-alcoholic beer is classified in subheading 2202 91 00 of the Combined Nomenclature. According to Note 3 to Chapter 22 of the Combined Nomenclature, for the purposes of heading 2202, the term ‘non-alcoholic beverages’ means beverages of an alcoholic strength by volume not exceeding 0.5 % vol.However, the term ‘alcoholic beverage’ is not defined in the EU legislation, and beer is not regulated at EU level.In the absence of EU rules in this respect, and in view of providing appropriate information to consumers, Member States may adopt provisions to determine the alcohol content thresholds that may trigger definitions such as ‘non-alcoholic’, ‘low-alcohol’, ‘de-alcoholised’ on beverages that are not regulated at EU level.In the UK, many, although not all, producers follow government guidance that says alcohol-free drinks may contain up to 0.05% ABV. But because the guidance is voluntary, in practice you might see alcohol-free labelled drinks that are up to 0.5% ABV for sale.
