Offences against the Person Act 1861 ss 58-59. . The "right to life of the unborn" is given constitutional recognition by Art 40 (3)(3) of the Constitution inserted by referendum in 1983. It follows that there is a general constitutional prohibition on abortion. . However, it has been held that termination of pregnancy is permissible under the Constitution where it is established as a matter of probability that there is a real and substantial risk to the life, as opposed to the health, of the mother, including a risk of death by self-destruction, and that the risk can be avoided by the termination of the pregnancy: AG v. X [1992] ILRM 401.

- Nóta Eine vorzeitige Beendigung der Schwangerschaft kann natürliche Ursachen haben (Spontanabort, spontaner Abort) oder künstlich herbeigeführt werden (Schwangerschaftsabbruch, Abtreibung). Beträgt das Gewicht der Leibesfrucht mindestens 500 Gramm, liegt nach § 31 Personenstandsverordnung eine Totgeburt vor, die im Personenstandsregister gemäß § 21 Abs. 2 Personenstandsgesetz beurkundet werden muss; bei einem Gewicht von weniger als 500 Gramm eine nicht im Personenstandsregister zu beurkundende Fehlgeburt. / L'avortement (l'interruption avant son terme du processus de gestation) peut être accidentelle (fausse couche spontanée) ou intentionelle (interruption volontaire, médicale ou thérapeutique de la grossesse). Si l'enfant conçu pèse au moins 500 grammes, il s'agit, aux termes du § 31 du Règlement allemand sur l'état civil, d'une naissance de mort né dont il faut dresser acte au registre d'état civil en vertu du § 21 alinéa 2 de la loi allemande sur l'état civil; si le poids n'atteint pas 500 grammes, il y a une fausse couche qui ne doit pas être enregistrée.
