Comment FRAND dates back to 1998. Terms were set out to ensure competition in the marketplace, while at the same time preventing infringement on a company's intellectual property. In theory, a manufacturer like Apple or Samsung would approach a patent-owner of a certain industry-standard feature, and reach settlement terms to use that innovation in a future device. FRAND and other standards policies like RAND, in the United States, help structure and guide these negotiations.
