    Comment "UK legal systems Regarding 'rights of custody' referred to in article 5 of the Hague Convention, cf Article 2(9) of Council Regulatiion No 2201/2003. It can be argued that the terms custody and access as used in the Hague Convention and Regulation 2201/2003 have an autonomous meaning . The terms custody and access were replaced in EN after Children Act 1989, and in SC after Children (Scotland) Act 1995, but remain in regular use (eg Official solicitor site (child abduction unit). The term 'residence' is not an an exact equivalent of 'custody' as formerly understood in UK law : the right of a person to have the child living with him or her (or otherwise to regulate the child's residence) and to control the child's day to day upbringing.The latter aspect of parental responsibility is not affected by a residence order. The rights deriving from a residence order arise only after judicial intervention. If the parents separate, for the purposes of child maintenance, irrespective of any court order, the parent with whom the child is living is the resident parent or the parent with care, and the other parent is the non-resident parent (Child Support Agency http://www.csa.gov.uk/en/maintenance/about.asp ;) Custody orders ceased to be available by virtue of the Children Act 1989 and Children Scotland Act 1995 and were replaced by the concept of parental responsability and residence orders, prohibited steps orders and specific issues orders under s.8 of 1989 Act or section 11 of 1995 Act. Part of the rationale of the change was the desirability of avoiding unnecessary court orders ie orders affecting parental responsibility more than is necessary.
