    Definition die in Artikel 32 Absatz 1 genannten Voraussetzungen: (1) Die Mitgliedstaaten stellen sicher, dass die Abwicklungsbehörden nur dann eine Abwicklungsmaßnahme in Bezug auf ein Institut im Sinne von Artikel 1 Absatz 1 Buchstabe a treffen, wenn die Abwicklungsbehörde der Ansicht ist, dass alle im Folgenden genannten Voraussetzungen erfüllt sind: a) Die zuständige Behörde hat nach Anhörung der Abwicklungsbehörde bzw. — unter den Voraussetzungen nach Absatz 2 — die Abwicklungsbehörde hat nach Anhörung der zuständigen Behörde festgestellt, dass das Institut ausfällt oder wahrscheinlich ausfällt. b) Bei Berücksichtigung zeitlicher Zwänge und anderer relevanter Umstände besteht nach vernünftigem Ermessen keine Aussicht, dass der Ausfall des Instituts innerhalb eines angemessenen Zeitrahmens durch alternative Maßnahmen der Privatwirtschaft, darunter Maßnahmen im Rahmen von institutsbezogenen Sicherungssystemen, oder der Aufsichtsbehörden, darunter Frühinterventionsmaßnahmen oder die Herabschreibung oder Umwandlung von relevanten Kapitalinstrumenten gemäß Artikel 59 Absatz 2, die in Bezug auf das Institut getroffen werden, abgewendet werden kann. c) Eine Abwicklungsmaßnahme ist gemäß Absatz 5 im öffentlichen Interesse erforderlich Reference "Richtlinie 2014/59/EU des Europäischen Parlaments und des Rates vom 15.     Definition "conditions referred to in Article 32(1) CELEX:32014L0059/EN, namely: 1. Member States shall ensure that resolution authorities shall take a resolution action in relation to an institution referred to in point (a) of Article 1(1) only if the resolution authority considers that all of the following conditions are met: (a) the determination that the institution is failing or is likely to fail has been made by the competent authority, after consulting the resolution authority or,; subject to the conditions laid down in paragraph 2, by the resolution authority after consulting the competent authority; (b) having regard to timing and other relevant circumstances, there is no reasonable prospect that any alternative private sector measures, including measures by an IPS, or supervisory action, including early intervention measures or the write down or conversion of relevant capital instruments in accordance with Article 59(2) taken in respect of the institution, would prevent the failure of the institution within a reasonable timeframe; (c) a resolution action is necessary in the public interest pursuant to paragraph 5."
