    Comment "Système juridique français Le ministre de l’intérieur a présenté, au Conseil des ministres du mercredi 28 novembre 2012, une circulaire concernant les conditions d’examen des demandes d’admission au séjour pour les étrangers en situation irrégulière. Cette circulaire doit s’appliquer à compter du 3 décembre 2012. Elle concerne les étrangers ayant des liens familiaux, professionnels et personnels importants en France. Plus précisément, elle s’adresse, sauf rares exceptions, à des étrangers installés depuis au moins 5 ans sur le territoire. Ainsi, pourront être admis au séjour : - les parents d’enfants scolarisés depuis plus de 3 ans, y compris en école maternelle, et installés depuis au moins 5 ans sur le territoire, - les étrangers, présents en France depuis plus de 5 ans qui démontrent avoir travaillé au moins 8 mois durant les 24 derniers mois et qui sont en mesure de présenter une promesse d’embauche ou un contrat de travail. - Une autorisation de travail pourra alors être délivrée aux étrangers employés dans des conditions satisfaisantes au regard de leurs qualifications et du droit du travail. Pour ceux qui auront travaillé sur des périodes d’au moins 2 ans, cette autorisation pourra, à titre dérogatoire, être accordée après 3 ans de résidence. Le ministre a également annoncé, pour 2013, la présentation d’un projet de loi réformant le code de l’entrée et du séjour des étrangers et du droit d’asile afin de mettre en place notamment un titre de séjour pluriannuel pour les étrangers en situation régulière ayant vocation à rester durablement sur le territoire.
