    Comment "Le retrait total de l’autorité parentale «porte de plein droit sur tous les attributs, tant patrimoniaux que personnels, se rattachant à l'autorité parentale» (art. 379, premier alinéa, code civil). Il entraîne donc perte des droits et des devoirs de protection et d’éducation, du droit de consentir au mariage ou à l’émancipation, de l’administration légale et de la jouissance légale, des différentes charges de la tutelle. Contrairement à la délégation, il porte également sur le droit de consentir à l’adoption (l’enfant pour lequel le retrait de l’autorité parentale a été prononcé peut donc faire l’objet d’une adoption plénière). Échappent en revanche au retrait de l’autorité parentale les droits et devoirs qui ne sont pas liés à l’autorité parentale, mais à la filiation (par exemple, les droits de succession subsistent. Par exception, le retrait de l’autorité parentale emporte pour l’enfant dispense de l’obligation alimentaire - art. 379, deuxième alinéa). Le parent déchu peut conserver un droit de visite et de correspondance. Le retrait total de l’autorité parentale s’applique également, sauf autre détermination, à tous les enfants mineurs déjà nés au moment du jugement (art. 379, premier alinéa, in fine).
